These terms of use govern the use of the website lazyhead.at, the LazyHead app (web, iOS, Android, desktop) and related services.

1. Provider and scope

The provider is LazyHead e.U., sole proprietor Andrii Snikhovskyi, Morizgasse 2/2/14, 1060 Wien, Österreich. Email: legal@lazyhead.at.

These terms apply to the website, the web, mobile and desktop apps and related services.

2. Service description

LazyHead is a digital platform and communication tool: candidates find roles, employers find candidates, and both communicate directly in chat.

LazyHead is not an employer, not a party to any employment relationship, and guarantees neither employment nor hiring. Regulated activities are offered only after the relevant authorisation.

LazyHead operates a job platform: we publish vacancy listings and establish contact. For job seekers the service is free of charge (§ 5 AMFG). LazyHead does not provide temporary staffing (Arbeitskräfteüberlassung) or individual recruitment consulting, and does not select or recommend candidates. Users verify each other on their own responsibility. Built-in translation is an aid, maps and distances are approximate, and an invitation to an interview is not a promise of employment.

3. Account

Use requires a valid email address and a role. You protect your credentials, do not transfer your account, are responsible for actions taken through it, and notify us if you suspect compromise.

4. Eligibility

You can create a candidate account from the age of 14 and an employer account from the age of 18. In addition, the necessary legal capacity or the consent of a legal guardian is required.

These limits concern the account only. Whether a minor may actually be employed follows the Austrian employment rules — in particular the KJBG, compulsory schooling and the type and format of the work (Lehre, Praktikum, Ferialjob). LazyHead does not check this; the employer is responsible.

5. Candidate obligations

You provide truthful information, hold the rights to documents you share, verify employers yourself and do not send unnecessary sensitive data.

6. Employer obligations

You publish only genuine vacancies, are authorised to represent the company, and comply with employment, migration and anti-discrimination law.

Fraud, unlawful payment requests and spam are prohibited; collect only necessary data.

7. User content

You keep the rights to your own content. You grant LazyHead only a limited technical licence to store, display, deliver, format-convert and, on request, translate content.

8. Prohibited conduct

Prohibited in particular are threats, discrimination, fraud, malware, unlawful content, spam, scraping and circumventing security measures.

8a. Trust levels and restrictions

Employer accounts have a trust level from 0 to 3 (details in the Privacy Policy, section 8a). It is derived from confirmed facts — phone number, register entry, work email address, payment on the website; documents are only a fallback.

Actions are restricted by level: without a confirmed phone number an account can create vacancies but cannot send messages. Without a confirmed company it cannot message job seekers first, send links in messages, or receive job seekers' CVs, contact details or identity. These actions unlock from the level shown in the app. In addition, volume limits apply to new conversations per hour and per day; when exceeded, the individual action is temporarily declined while the account itself is unaffected.

Whoever registers a company warrants that they are authorised to represent it and that the details are correct. Using another company's identity or register data is prohibited and leads to immediate suspension of the company and termination for cause. Business users indemnify LazyHead against third-party claims arising from such a violation.

Confirmed violations after a report and review temporarily lower an account's trust level; in case of repeated, manifestly illegal content we suspend the account for a reasonable period after prior warning (Art. 23 DSA). Every measure is communicated with reasons and can be contested via the route in section 13 or by email to us; objections are reviewed by a human (Art. 20 DSA).

Job seekers' data an employer receives via LazyHead (e.g. CV, contact details) is processed by the employer on its own responsibility as a controller under the GDPR and solely for the purpose of filling the position (§ 6 AMFG).

9. Translation

Translation is an assistive feature and may contain errors. Legal, salary and safety-relevant content must be verified by a human.

10. Maps and location

Location and map data may be approximate. You verify the address and route yourself.

11. Interview planner

The planner is an organisational tool. You check date, time zone and format yourself; an invitation does not guarantee hiring.

12. Moderation

LazyHead may limit visibility, demote or remove content, hide vacancies, suspend or terminate accounts, request clarification and preserve evidence within the law.

Means used: an automated check of job ads for unlawful statements (among others age, gender, origin, religion, and a missing collective-agreement minimum pay), an automated pre-check of submitted verification documents, and subsequent review by our staff.

Only one decision is automated: blocking publication of an ad with clearly unlawful statements. Every other measure — removing content, restricting companies and accounts — is taken by a human. We inform the affected person of each measure with reasons and information on redress.

Reports and appeals go through support or legal@lazyhead.at. We announce material changes to these terms in advance in the app or by email.

13. Reporting illegal content

You can report fraud, unlawful vacancies, discrimination, threats and rights violations through support, or directly on a vacancy or in a chat. We review reports and take appropriate action.

Independently of that, any individual or entity — including without a LazyHead account — can report illegal content to legal@lazyhead.at (Art. 16 DSA). The procedure, the details we need, our timelines and how to appeal are set out on the page “Report illegal content”.

14. Availability

Maintenance and interruptions are possible. Uninterrupted availability is not guaranteed.

15. Fees, subscriptions and payment terms

For job seekers, using LazyHead is free of charge and stays free of charge: we never charge job seekers for the placement service (§ 5 AMFG). Only employer subscriptions and add-on services are paid.

Subscriptions are offered exclusively to entrepreneurs within the meaning of § 1 KSchG / § 343 UGB. By subscribing you confirm that you enter into the contract for your company or self-employed activity; no consumer contracts are concluded. Consumer-protection provisions (in particular FAGG withdrawal rights) therefore do not apply.

Prices: Business Monthly €21.00 per month or Business Yearly €222.00 per year; optionally the add-on package “+5 vacancies” at €11.00 per month. All prices include 20% Austrian VAT. Both subscriptions provide the same features and differ only in the billing period. The price shown during checkout is decisive; the invoice is issued to the company (with VAT ID where provided).

Trial: new employer accounts receive a one-time 3-day free trial — with no obligation to provide payment details. The trial ends automatically; NO subscription is created and nothing is charged. One trial per company or confirmed phone number; promotional codes may extend access. To protect job seekers, the trial is limited while the company is not yet confirmed (currently: 1 active vacancy and a limited number of new conversations per day; the current values are shown in the app). The full trial unlocks immediately once the company is confirmed — via registry match (Firmenbuch/GISA), VAT-ID check through the EU VIES system, a confirmed e-mail address on the company domain, or voluntary verification of a payment card (a €0 check; nothing is charged).

The subscription starts only with your order and payment and then renews automatically for the respective billing period until cancelled. At least 7 days before each renewal we send an e-mail reminder with the amount, date and how to cancel.

Cancellation: at any time with effect from the end of the paid period — in the payment portal (Plan & subscription) or by e-mail. Until the end of the paid period, access and published vacancies remain; afterwards vacancies are deactivated and the account returns to the free state. Data is retained in accordance with the Privacy Policy.

If a charge fails, payment is retried; until successful payment the paid feature set may be limited (existing chats remain readable). Refunds: there is no refund for paid, unused periods upon cancellation. In the event of significant technical outages attributable to us, we refund or credit the share attributable to the downtime. Statutory warranty rights remain unaffected.

Price changes are announced by e-mail at least 30 days before they take effect and apply only from the next billing period; periods already paid remain unchanged. In the event of a price increase you may cancel with effect from the end of the current period before the increase applies. An annual adjustment in line with the Austrian consumer price index (VPI) remains reserved.

The add-on package is billed monthly, requires an active subscription and can be cancelled monthly. Promotional codes grant additional access days, can be redeemed once per account and have no cash value. Payments are processed via Stripe; for TOP placement, section 15a additionally applies.

15a. TOP placement

TOP placement is a paid service for employers: an active vacancy is shown among the first results to matching job seekers for the chosen number of days and is labelled as a paid placement (§ 6 ECG, UWG Annex no. 11a).

No particular position — in particular no #1 spot — is guaranteed: TOP vacancies rotate fairly among themselves, and a vacancy is shown only to job seekers whose search it matches. The placement changes neither the relevance check nor the order of the other results.

The price depends on the duration and is shown before payment; it includes 20% Austrian VAT. Payment is made exclusively on the website as a one-off payment; the invoice is issued to the company. An extension adds days after the current end. TOP placement does not replace a subscription and requires an active vacancy.

If the vacancy is deactivated, archived or removed for a violation during the term, the placement ends; unused days are not refunded in that case. In the event of a technical failure on our side we refund the share attributable to the downtime.

Business users have no statutory right of withdrawal; the service starts upon activation. The placement is provided under our trade licence as an advertising agency (Werbeagentur).

16. Intellectual property

The brand, software, design, texts, logo and database structure are protected. Your rights to your own content remain unaffected.

17. Privacy

Information on data processing is available in the Privacy Policy.

18. Termination and deletion

You may stop using the service at any time and request deletion of your account. LazyHead may restrict an account for legal, security or fraud violations or a material breach of these terms.

19. Liability

Liability is not excluded for intent, for gross negligence where exclusion is unlawful, for harm to life and health, for mandatory consumer rights and for mandatory statutory liability. Otherwise statutory liability applies.

20. No verification guarantee

We do not guarantee the identity, qualification or solvency of users, the lawfulness of every vacancy, or the existence of every company. Users carry out reasonable checks of their own.

This does not affect LazyHead's statutory responsibility as a job placement service: we are liable under § 4(6) AMFG for incorrect information we ourselves provide about a vacancy and for any impermissible disclosure of job seekers' data. This section does not exclude that liability.

21. Changes

We communicate material changes clearly; they do not apply retroactively.

22. Governing law

Austrian law applies; mandatory consumer-protection provisions remain unaffected. No unlawful exclusive jurisdiction is imposed on consumers; for businesses, Vienna applies subject to final legal review.

23. Severability

If individual provisions of these terms are or become invalid, the validity of the remaining provisions is unaffected. Mandatory statutory provisions remain unaffected.
